Under applicable provisions of law, mortgage credit intermediaries have the statutory obligation to make a payment to cover the costs of supervision.
The amount of, the method of calculating and the time limits for making the payment are set out in the Regulation on payments to cover the costs of supervision of mortgage credit intermediaries (available in the Polish language).
A mortgage credit intermediary calculates an advance payment to cover the supervision costs in the amount of 0.2% of the total revenue from mortgage credit mediation generated by the intermediary, including its agents, in the calendar year preceding the year for which the advance payment is made.
Time limit for making the advance payment and submitting the statement: by 30 June of the current year
When making the advance payment, a mortgage credit intermediary must submit a statement to Urząd Komisji Nadzoru Finansowego.
A mortgage credit intermediary that commences its activity must make the first advance payment for the calendar year that follows the year of the commencement of its activity.
By 30 September of each year, a Communication from the Chair of Komisja Nadzoru Finansowego on the applicable rate and the amount of supervision costs to be paid in the current calendar year is published.
By 31 October of each year, a mortgage credit intermediary is required to submit to Urząd Komisji Nadzoru Finansowego a statement on the amount of the payment to cover the supervision costs for the current calendar year (the information to be included in the statement is specified in the Annex to the Regulation).
A mortgage credit intermediary’s statement on the payments made to cover the supervision costs for the current calendar year must be submitted in the form of electronic document through the e-Deklaracje system available at: https://e-deklaracje.knf.gov.pl/ (to set up a user account in the system, the last five digits of a micro account will be required). In the case of an overpayment the refund will be made by bank transfer to the bank account within 30 days from the date of submission of the statement.
In the case of an underpayment a mortgage credit intermediary must pay the amount due by bank transfer to the bank account of Urząd Komisji Nadzoru Finansowego within 30 days from the date of publication of the Communication..
The payment to cover the supervision costs is of a public-law nature, and hence Urząd Komisji Nadzoru Finansowego (UKNF) does not issue VAT invoices or bills for such payment.
The payments to cover the supervision costs must be made to individual accounts generated by the UKNF for each entity.
