Investment fund management companies - Komisja Nadzoru Finansowego

Only a joint-stock company (PL: spółka akcyjna) with its registered office in the territory of the Republic of Poland which has been authorised by Komisja Nadzoru Finansowego (hereinafter: ‘KNF’) may be an investment fund management company.

The legal basis for granting the authorisation and the rules of operation of investment fund management companies are provided in the Act of 27 May 2004 on investment funds and management of alternative investment funds (Journal of Laws 2016, item 1896, as amended, hereinafter: ‘Act on investment funds and management of alternative investment funds’).

An investment fund management company may conduct its activities both in the territory of the Republic of Poland and in the territory of other EU Member States  and the EEA countries, by establishing a branch or as part of its cross-border activities.
