Rules for handling reports on irregularities in the functioning of entities operating in the financial market

If you report irregularities in the functioning of an entity operating in the financial market to the Office of Komisja Nadzoru Finansowego (Urząd Komisji Nadzoru Finansowego), please remember that:

  1. the actions taken by Komisja Nadzoru Finansowego are, as a rule, covered by professional secrecy referred to in Article 16 of the Act of 21 July 2006 on financial market supervision, therefore you will not be informed about how the information you reported is used,
  2. the Office of Komisja Nadzoru Finansowego does not provide a reply to the reports on irregularities it receives,
  3. to protect your individual interests please contact the competent entity.

The Office of Komisja Nadzoru Finansowego is a state legal person whose task is to provide support and assistance to Komisja Nadzoru Finansowego.

Komisja Nadzoru Finansowego exercises supervision over the financial market, including the following entities:

  • banking sector entities, including:

a) banks in the form of a joint-stock company,

b) mortgage banks,

c) state-owned banks,

d) cooperative banks,

  • capital market entities, including:

a) share issuers,

b) investment firms and tied agents of investment firms,

c) securities brokers,

d) investment advisers,

e) investment funds and investment fund management companies,

f) crowdfunding service providers (investment crowdfunding), 

  • insurance market entities, including:

a) insurance undertakings operating as joint-stock companies,

b) insurance undertakings operating as mutual insurance societies,

c) branches of foreign insurance undertakings,

d) indirect insurance (reinsurance) undertakings,

e) branches of reinsurance undertakings,

  • pension market entities, including:

a) open pension funds managed by general pension societies,

b) voluntary pension funds managed by general pension societies,

c) occupational pension funds managed by occupational pension societies,

  • payment services market entities, including:

a) domestic payment institutions,

b) payment services offices,

c) credit unions,

d) small payment institutions,

e) domestic electronic money institutions,

  • entities of the credit unions sector, including credit unions,
  • non-bank lending institutions.

The tasks of Komisja Nadzoru Finansowego do not include taking a position on individual matters of consumers or reviewing the allegations they have reported.

Komisja Nadzoru Finansowego does not:

1) take a position on individual matters concerning irregularities in the functioning of financial market entities,

2) issue legal opinions,

3) provide individual legal assistance in respect of the irregularities reported.

Information on irregularities in the functioning of supervised entities may be used by Komisja Nadzoru Finansowego in its supervisory actions.  

Information on irregularities in the functioning of entities operating in the financial market may be reported to the Office of Komisja Nadzoru Finansowego

  • in writing:

  • electronically: 

a) to: knf@knf.gov.pl,

b) using the form on the ePUAP website.
