Occupational pension schemes
Polish occupational pension schemes may be operated by a pension institution from another EU Member State. Such situation is regulated by:
Article 20 of Directive 2003/41/EC of the European Parliament and of the Council of 3 June 2003 on the activities and supervision of institutions for occupational retirement provision (IORP Directive),
Budapest Protocol adopted also by Polish Financial Supervision Authority (KNF).
According to Article 20, par. 5 of the IORP Directive, the competent authorities of the host Member State (in Poland – Polish Financial Supervision Authority - KNF) are required to inform the competent authorities of the home Member State of the requirements of social and labour law relevant to the field of occupational pensions in the host Member State.
